Terms of Service

By commissioning me you recognize and agree to be legally bound by the following Terms of Service listed below; failure to abide by my T.O.S may result in a rejected/cancelled commission with or without a refund (depending on the case), and/or a blacklist. Please note that my Terms of Service may be subject to change or be expanded upon at any moment!⚠️ Last updated JANUARY 1ST, 2026 ⚠️✦ SECTION 1.1 - WILL DRAW
I'm willing to draw any of the following:✦ Animals (foxes, wolves, felines, etc; feral AND anthro) ✦
✦ Reptiles (dragons, reptiles, dinosaurs etc) ✦
✦ Monsters (aliens, creatures, etc; depending on the design) ✦
✦ Birds (owls, crows, etc) ✦
✦ Fish (sharks, etc) ✦
✦ FNAF Animatronics/Tattletails ✦
✦ Humans/Humanoids ✦
✦ Light Gore (Ex:. Excessive blood, wounds, detached limbs, etc) ✦
✦ Fanart ✦
✦ Couples (This includes but is not limited to: Canon x Canon, Canon x OC, OC x OC, Male x Female, Male x Male, Female x Female) ✦✦ SECTION 1.2 - WILL NOT DRAW

✦ Sexualized underage characters (in actual age and appearance) ✦

✦ Anything else I may be uncomfortable with ✦✦ SECTION 2 - GENERAL✦ I hold the right of declining/canceling a commission if it breaks my rules or if I have a personal reason to ✦
✦ You, the commissioner, holds the right of cancelling a commission if you wish (Please see section 6 for more information on cancellations) ✦
✦ I have the right to upload/share the commissioned artworks on my social medias unless the commissioner requests me not to and specified beforehand that the commissioned piece should remain private ✦
✦ I start working after receiving the full upfront payment, but partial payments can be discussed ✦
✦ Depending on the complexity of a character design there may be an added fee to the commission total ✦
✦ PLEASE don't rush me. I struggle with carpal tunnel syndrome and wrist pains but I do the best I can to deliver commissions as soon as possible, and I do not work well with strict deadlines or rushing orders. If you need a piece by a certain deadline, feel free to discuss it with me beforehand so I can see if it's within my reach to deliver by then ✦
✦ Returning clients are eligible to obtain stamps on your Loyalty Card! Read more information here! ✦
✦ I work at my own pace, but you are free to ask about wips and progress every once in a reasonable while! ✦
✦ If you request a commission or a hold on a commission slot and then ghost me after multiple attempts to contact you, you will be blacklisted. It is completely fair and understandable to be unable to proceed with the commission, to be unable to pay or to lose interest, but communication is key. Life happens, and it's completely fine if you need to cancel; just please let me know! if you don't have the commitment to communicate clearly and simply disappear, I won't feel comfortable working with you again. ✦
✦ BLACKLIST ✦✦ SECTION 3 - IMAGE RIGHTS✦ You, the commissioner, are allowed to make minor alterations to the completed commission such as cropping, adding text/borders, changing brightness/contrast, hue/saturation, etc ✦
✦ You are allowed to post your commissioned art for personal/non-commercial use on your social medias/websites (Tumblr, Toyhouse, etc) but PLEASE remember to give credit and a linkback to any of my social medias (If the commission includes characters that do not belong to you, additional credit to the owner(s)/creator(s) of said characters must be provided when using/reuploading for personal/non-commercial use) ✦
✦ If you're posting my art on Toyhouse, please credit the artist as my profile in TH, MarcellaYouko! ✦
✦ You may not use the commission for any commercial use unless discussed with me beforehand; please send me any inquiries you may have about commercial use of the commission(s) ✦
✦ Commissions for commercial use will be charged more than personal/non-commercial commissions; prices are negotiable
(If the commission includes characters that do not belong to you, you cannot use the commission for commercial use unless explicitly written permission from the owner(s)/creator(s) of said characters is provided) ✦
✦ Any and all artworks are NOT to be used in relation with generative AI in any form or capacity. It may not be used to train any Al programs, reproduced, altered or used in conjunction with AI content. Any client or otherwise found to be using my work in conjunction with AI will be given a permanent blacklist from future dealings and lose ALL personal rights to their commission without refund. I reserve the right to take legal action against any unauthorized use of my work ✦
✦ You may not profit from the completed artwork. This means no selling the digital files, no selling the rights, and absolutely no selling the piece as an NFT ✦
✦ Do not claim the art as your own, whether you did or did not make any edits to the commission ✦
✦ I do not claim ownership over any of the characters/subjects portrayed in the commission; all characters belong to their respective creator(s) ✦✦ SECTION 4 - DELIVERY/ TURNAROUND✦ All commissions will be done digitally (There will be no physical items; you, the commissioner, is paying for a service/digital good and will not require any shipping of any kind) ✦
✦ All commissions will be sent via the method of initial contact (Toyhouse, discord, etc) unless requested to be sent through a specific way ✦
✦ You will receive the completed watermarked commission and may request an unwatermarked version for private use ✦
✦ If a sketch is requested for approval and sent and I don't hear back within one month (after further attempts to receive a response), I reserve the right to complete and deliver the piece as-is ✦
✦ Unless specified not to upload the commission to the public, commissions are subject to be posted on my social media; I will always upload the watermarked versions (You may choose to remain anonymous when I publicly upload the commission) ✦
✦ I don't have an expected turnaround time since I depend on the time I have available on a computer daily but it can range from 1-2 weeks to 1-3 months (If I have to take longer than 4 months to complete the commission for whatever reason, you will be contacted and informed of the status of your commission) ✦
✦ Related to the above, I also struggle with wrist pains due to carpal tunnel syndrome; which means sometimes I might draw slower to avoid worsening my pains, I hope you understand! ✦
✦ Clients are more than welcome (and encouraged) to check my Trello for updates on my queue, I keep it frequently updated! ✦
✦ You may also contact me for updates if completion of the commission has exceeded more than 4 months, just as you could in a regular occasion ✦
✦ I have more limited computer access during the weekends so updates may be slowed during that time; you will most likely see more frequent updates and receive your finished commission during the week ✦✦ SECTION 5 - PAYMENT✦ Payment is made upfront and in full, but partial payments can be discussed and arranged through different steps of the commission process ✦
✦ Payment is to be made via PayPal, Ko-Fi or DeviantArt Points only (100 points = 1.00 USD) ✦
✦ I unfortunately do not have access to CashApp, Venmo or other services which are unavailable in my country ✦
✦ PayPal payment is to be done in USD (United States Dollars) ✦
✦ PayPal payment will be done through invoices; I will require your PayPal e-mail to send you the invoice ✦
✦ Payment through DeviantArt Points is to be made using the Commissions Widget on my DeviantArt profile page or through the donation widget (If you're paying through a commission widget, I will set up a specific slot for you to pay through) ✦
✦ Please send the payment within 72 hours after confirmation unless a certain payment date has been specificed beforehand ✦
✦ If payment is not sent after 72 hours I will contact you for further confirmation ✦
✦ If no response has been given after another 24 hours have passed after the first contact I will reopen the commission slot for someone else; you are free to contact me later for another slot ✦✦ SECTION 6 - REFUNDS✦ If you wish to cancel a commission, the following refund policy will apply:
- Full cancellation before work begins: You'll receive a 90% refund.
- Cancellation during the sketch phase: A 50% refund is issued.
- Cancellation after the sketch is finished: No refund. ✦
✦ You will not receive any files if the commission is cancelled other than the ones I could possibly have already sent up until that point ✦
✦ If I am unable to complete the commission due to any personal reasons I will contact you for a refund ✦
✦ You, the commissioner, will not be refunded if you are unsatisfied with the commission ✦
✦ If you are unsatisfied with the commission I'm willing to discuss and make minor edits (ex:. adjusting colours), up to a maximum of 2 times after correspondence. I won't be able to do any major revisions such as reposing, design change, different character, etc ✦
✦ I can make minor edits about details I may have missed/forgotten (and that were previously specified) such as character markings, tattoos, accessories, etc ✦
✦ The only major revisions I can do are details that I may have missed/forgotten and that were specified by you in the order form/correspondences while the commission was still in the sketching/lineart stage ✦
✦ You have the right to ask me for minor fixes/alterations ONLY soon after the commission is finished, not months after! ✦✦ SECTION 7 - COMMISSION PROCESSThe following is a sample of the my commission process:✦ You will order using the specifed form through the contact method of your choice; if you choose to contact me through e-mail your e-mail will remain private and will not be shared with anyone (If you move accounts or leave your social media(s), please inform me a way to contact you if I'm not done with your commission so I can deliver it to you!!⚠️) ✦
✦ Please have a clear DIGITAL colored and unshaded reference ready (I won't be able to accept commissions with traditional or written references, as it'd make me anxious and uneasy about mistakes) ✦
✦ You can request to receive a rough sketch of the commission before I proceed with working on it; any and all major revisions can be done at this stage (After the rough sketch is accepted I will resume working on it) ✦
✦ Upon completion of the commission, you will receive the finished commission file via the previous method of contact/your method of choice. Only minor changes (ex:. brightness, colour adjustments, etc.) can be made at this point ✦✦ If interested, please use the following form when commissioning! ✦Commission Type: shaded headshot, etc

As stated on Section 2 of my T.O.S:"If you request a commission or a hold on a commission slot and then ghost me after multiple attempts to contact you, you will be blacklisted. It is completely fair and understandable to be unable to proceed with the commission, to be unable to pay or to lose interest, but communication is key. Life happens, and it's completely fine if you need to cancel; just please let me know! if you don't have the commitment to communicate clearly and simply disappear, I won't feel comfortable working with you again."The same applies for adoptables.
